Verkhovna Rada is trying improve the scope of waste production and consumption

September 17, 2014 - Verkhovna Rada in the first reading adopted the draft of Law of Ukraine "On the Packaging and Packaging Waste" №4266 from 08.07.2014.

This law builds on adaptation of Ukrainian legislation to the EU legislation, the Law of Ukraine "On the State Program adaptation of Ukrainian legislation to the legislation of the European Union" (EU Directive 94/62/EU of 20/12/94, as amended on 11.02.2004). 

The situation in Ukraine in the sphere of production and consumption waste is critical and one of the main threats to the ecological security of the country. Today, no one knows the situation in the market and is not responsible for compliance with the rules of recycling and, as a consequence, the environmental situation in the country is actually controlled. 

It should be noted that despite the fact that the bill was designed on the basis of the EU Directive 94/62/EU of 20.12, though the document has a number of disadvantages.

Most provisions of the law are solely declarative, regulating the issues of preventing the formation of packaging waste for re-use of packaging materials. 

For example, in Article 9, "Requirements for packaging" has no fundamental requirements for the production of packaging to minimize the weight of the package in the production, packaging materials minimize the amount of harmful and hazardous to human health and the environment of substances, sanitary and epidemiological safety of packaged products and etc.), which should be enshrined in statute and on basis of which the normative and technical documents are in the relevant field.
